The general practice, pursuant to state laws across the United States, is to limit access to a birth certificate to a child and his or her parents. There are exceptions to this general practice. Moreover, a person who has legal authority to access a birth certificate can disclose the document to whoever he or she may desire
The U.S. Constitutions mandates that courts be open to the public. This stems from the practice in the British Empire, including in the American colonies, to keep certain court proceedings away from the public.
In the case of a marriage that fails, divorce records represent the most voluminous set of documents associated with the marriage. The default standard is that divorce records are public, with a few common exceptions.
Documents associated with divorce records that pertain to minor children may have restricted public access. Certain types of financial information submitted to the court during divorce proceedings may also be unavailable to the public-at-large.
The possibility also exists that a divorce case may be sealed by the court. This sometimes happens in the case of a celebrity couple. Good cause for sealing any type of court record must be demonstrated before a court will take this significant step. A court may seal some, but not all of the documents in a particular divorce case.
