Are Marriage Records Part of the Public Record?

Questions arise as to what types of records are available to the public-at-large. One of the most intimate, personal of all relationships is that associated with marriage. A logical question is whether or not marriage-related records are available to the public in the United States.

When considering the broad category of marriage, there are three general types of records associated with married people. These are the marriage license, birth certificates and divorce records.

Marriage License

There can be a variety of different types of records associated with marriage. The primary one is a marriage license. In the United States, a couple intending to marry must obtain a license, which typically is issued by an official on the county level. Oftentimes this is the country clerk or clerk and recorder. A marriage license is a public record.

Birth Certificate

Although not always associated with marriage, a type of record oftentimes associated with marriage is a birth certificate. Unlike a marriage license, state laws across the United States are more restrictive about who can have access to a birth certificate.

The general practice, pursuant to state laws across the United States, is to limit access to a birth certificate to a child and his or her parents. There are exceptions to this general practice. Moreover, a person who has legal authority to access a birth certificate can disclose the document to whoever he or she may desire

Divorce Documents

The U.S. Constitutions mandates that courts be open to the public. This stems from the practice in the British Empire, including in the American colonies, to keep certain court proceedings away from the public.

In the case of a marriage that fails, divorce records represent the most voluminous set of documents associated with the marriage. The default standard is that divorce records are public, with a few common exceptions.

Documents associated with divorce records that pertain to minor children may have restricted public access. Certain types of financial information submitted to the court during divorce proceedings may also be unavailable to the public-at-large.

The possibility also exists that a divorce case may be sealed by the court. This sometimes happens in the case of a celebrity couple. Good cause for sealing any type of court record must be demonstrated before a court will take this significant step. A court may seal some, but not all of the documents in a particular divorce case.
