Are Criminal Records a Public Record?

They always say that your past has a way of coming back to haunt you. This is definitely the case when it comes to your criminal records. Your criminal records can be pulled indefinitely. The only records that are unable to be viewed are crimes committed as a minor. Once you are an adult, your criminal record never goes away, though some no longer hold old crimes against you. 

Making Your Way Through The System

When you commit a crime, you are arrested and or charged. This crime goes through the court system. Your arrest, mug shot, sentencing, and overall court docket all becomes part of your public record. Anyone who wants to see this record can check the local court websites, go to the courthouse, or ask you for a release of information to have them mailed. A release of information may have many things included on the application. This can include credit, job history, and of course criminal history. The types of crimes are what makes things a bit more complex. Depending on what crime you committed and what court handles the case, it may or may not show up on a generic police report. 

Understanding Misdemeanors and Felonies 

If you commit a crime at the municipal level, which would be misdemeanors, your local jurisdiction would handle it. If you commit a crime that is of a felony level, it is bound over to the common pleas court. A federal court is for those who have committed a crime on federal matters. If there is no official arrest, which happens in many misdemeanors cases, then the record may be hard to find from a national standpoint. Now, to get the full level of your criminal misdoings, a party would need to pull a BCI report. To do this they would need to get your fingerprints and send them off. A report from the Bureau of Criminal Investigation would come back within a few weeks. If you have never been fingerprinted, it is a whole different ball-game. 

The BCI Report

A BCI report is the only way to get the full picture of your criminal history. Even still, a BCI may not show local stuff or charges that were handed down through the municipal court. When you have small charges that never had jail time, those can be harder to track down, but they are not impossible to find. When you are booked, taken to jail, and have court hearings; it is a whole different story. Those fingerprints are your link to your criminal report. If you try to get a job that requires a background check, anything done with fingerprinting will pull up all your deeds. 

All Crimes Are Public Record

So, yes anyone can get your criminal history at any time. It is a matter of public record, and whether you consent or not, your sins will find you out. Anyone that goes to jail must be fingerprinted. Your fingerprints go into a database with all the other offenders. Anyone that pulls your fingerprints can see anything you have done. Now, the smaller municipal court charges probably won't come up as most of the time they don't require fingerprinting.
