Nebraska, joined only by North Dakota, requires a five of seven vote to rule a legislative provision unconstitutional.

The Origin of the Nebraska Federal Courts

The Nebraska Federal Court was founded by way of the Kansas-Nebraska Act in 1854, and it was initially named the Territorial Supreme Court. Originally, the court was occupied by a panel of judges made up of 15 males. In 1938, the number was reduced to three. The current count of seven judges did not happen until the state constitution was amended in 1908. Now, as stated above, the Nebraska Federal Court selects and elects judges using a form of the Missouri Plan.
