The FCRA is US Federal Government Legislation which was created to protect the privacy of consumer information held by consumer reporting agencies. The FCRA is meant to protect consumers from any inclusion of inaccurate information found in their credit reports. The FCRA created a standard by which any company that holds consumer information for the purposes of employment or tenancy. is by definition an information reporting company. The FCRA creates a standard by which certain information reporting companies must adhere. If an information reporting company/agency is to be allowed to furnish reports used for the purposes of determining employment or tenancy then that company/agency must comply with the standards which were set by the FCRA.

The two types of information reporting companies/agencies which furnish background checks are companies/agencies which are used for employment and tenancy, and those that are not. Because of the higher standard that companies must adhere to if they are a consumer reporting agency as defined by the FCRA, there are big differences in the costs associated with running reports with these two types of information reporting companies. As a general rule, it is much more costly to run a report for the purposes of employment or tenancy.
